Terms of Service

These Terms of Service ("Terms") govern your use of lodestartcg.com (the "Site") and any purchase you make from it. The Site is operated by Lodestar GmbH, a limited liability company incorporated in Switzerland, trading as "Lodestar TCG" ("we", "us", "our"). By placing an order you agree to these Terms.

Products and authenticity

We sell factory-sealed One Piece Trading Card Game products (booster boxes and displays). All product is sealed by the manufacturer, Bandai Co., Ltd.

Lodestar TCG is an independent reseller. We are not affiliated with, endorsed by, sponsored by, or otherwise connected to Bandai Co., Ltd. All trademarks, product names and imagery are the property of their respective owners and are used for descriptive purposes only. As sealed product, contents are determined by the manufacturer; we cannot guarantee the presence of any particular card within a sealed item.

Prices and taxes

  • All prices are shown in Swiss francs (CHF).
  • Lodestar GmbH is not registered for Swiss VAT (MWST). Prices therefore do not include Swiss VAT and no separate VAT number is issued; our commercial identifier is the UID stated above.
  • Orders shipped to the European Union may be subject to import VAT and/or customs duties on delivery, payable by the recipient. These charges are set by the destination country and are not included in our prices or shipping charges. (We expect to offer prepaid EU import VAT via the IOSS scheme as a future update; until we announce it, EU import charges are the recipient's responsibility.)
  • We may correct any pricing errors and, where a price was manifestly incorrect, decline or cancel the affected order with a full refund.

4. Orders and contract formation

Your order is an offer to buy. A binding contract forms when we send you an order confirmation or dispatch the goods, whichever is earlier. We may decline or cancel an order (for example, where product is unavailable, an allocation is cut, or a pricing error occurred); in that case we refund any amount already paid in full.

5. Pre-orders

Where an item is offered for pre-order: payment is taken in full at checkout; you may cancel free of charge before dispatch; and you are entitled to a full refund if the allocation is cut or if the manufacturer's release is delayed by more than 60 days beyond the expected release date shown at the time of your order. Estimated release dates are set by the manufacturer and may change.

Delivery, and passing of risk

We ship as described in our Shipping Policy. Risk of loss or damage to the goods passes to you when you (or a third party you name, other than the carrier) take physical possession of the goods — that is, on delivery to you, not on our handover to the carrier. Delivery time estimates are not guaranteed.

Right of withdrawal / returns

Your statutory right of withdrawal (EU/EEA) and our voluntary Swiss return policy are set out in full in our Return and Refund Policy, which forms part of these Terms.

Warranty and liability

Statutory warranty rights for defective goods apply and are not excluded or limited by these Terms. To the fullest extent permitted by law, we are not liable for indirect or consequential loss. Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, and nothing in these Terms affects the mandatory consumer-protection rights available to you under the law of your country of residence.

Governing law and jurisdiction

These Terms and any purchase are governed by the substantive law of Switzerland, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG) and excluding conflict-of-law rules. The place of jurisdiction, so far as legally permissible, is Stans, Canton of Nidwalden, Switzerland.

If you are a consumer: the above choice of law does not deprive you of the protection afforded to you by the mandatory consumer-protection provisions of the law of the country in which you are habitually resident, and you may bring proceedings in the courts of your country of residence where the Lugano Convention so provides.

Changes

We may update these Terms; the version in force at the time of your order applies to that order.

EU online dispute resolution

The European Commission provides an online dispute resolution (ODR) platform at https://ec.europa.eu/consumers/odr. We are not obliged, and do not undertake, to participate in dispute-resolution proceedings before a consumer arbitration board, but the platform is available to EU consumers.
